1. Acceptance of Terms

These Terms of Service and Purchase Conditions (this "Agreement") govern all purchases made through PlayMusic123.com, whether online, by phone, or by text. By placing an order or making a purchase from PlayMusic123.com, you agree to be bound by and to accept this Agreement in its entirety.

 

This Agreement may not be altered, supplemented, or amended by the buyer through any other document. PlayMusic123.com reserves the right to refuse service to anyone at any time. Orders are not binding upon PlayMusic123.com until accepted. Acceptance is indicated by an order confirmation email or by shipment of the ordered items.

 

If you do not agree to these terms, do not use this website or place any orders.

 

2. Pricing & Product Information

All prices, product descriptions, and availability are subject to change without notice. PlayMusic123.com does not guarantee the accuracy or completeness of pricing or product information displayed on the website.

 

Although we work to keep pricing current, manufacturers may change prices without prior notice to us. PlayMusic123.com reserves the right to cancel any order placed at an incorrect price. We will notify you promptly if this occurs and provide a full refund if payment has already been processed.

 

All prices are displayed in U.S. Dollars (USD). PlayMusic123.com is not responsible for currency conversion differences for international orders.

 

Some products — including those identified as Hot Buys, Closeouts, or Limited Quantity items — are offered on a first come, first served basis and are limited to stock on hand.

 

3. Payment

Orders may be paid for using the following methods: Visa, Mastercard, American Express, Discover, JCB, Diners Club, Shop Pay, Apple Pay, Google Pay, PayPal, Bread Financing, and Progressive Leasing.

All transactions are processed securely. PlayMusic123.com is powered by Shopify and is PCI DSS Level 1 compliant. We do not store your full payment card details on our servers.

Sales Tax

PlayMusic123.com is required by law to collect sales tax on orders shipped to addresses within the State of California. California sales tax is calculated based on the shipping address at checkout. Orders shipped to all other U.S. states are not subject to California sales tax.

Financing — Bread Pay

We offer Bread Financing, which allows customers to pay for purchases over 12, 24, or 36 months at competitive interest rates, or up to 12 months at as low as 0% APR. Financing is subject to credit approval and Bread's terms and conditions. PlayMusic123.com is not responsible for Bread's lending decisions or financing terms.

Progressive Leasing

Progressive Leasing is available as a lease-to-own option with no credit required. Progressive Leasing is a separate financial product and is subject to Progressive's own terms and conditions.

Order Verification

To protect customers from fraud, all orders are subject to a billing verification process. There may be a delay of up to 24 hours to verify billing information. Initial orders and orders shipping to alternate addresses may be held for extended verification. We reserve the right to make partial shipments.

 

4. Order Cancellations

You may cancel your order if it has not yet been processed or shipped. To request a cancellation, contact us at support@playmusic123.com or text (888) 285-5308 as soon as possible after placing your order.

If your order has already been processed or shipped, it cannot be canceled. In that case, you will need to initiate a return after delivery in accordance with our Returns Policy.

  IMPORTANT: Special orders cannot be canceled at any time once placed. Special orders are final sale. See Section 8 for full details.

 

5. Shipping & Delivery

Free Shipping

PlayMusic123.com offers free Standard Shipping on all orders shipped to the contiguous 48 U.S. states and the District of Columbia. No minimum order is required.

Processing Times

Our fulfillment center operates Monday through Friday, 9:00 AM to 12:00 PM Pacific Standard Time, excluding holidays and weekends. Orders placed outside fulfillment hours are processed the next business day.

  Standard orders: 1 to 3 business days after cleared payment.

  Large or oversize items: 7 to 12 business days. These ship via freight service.

  Same-day shipping: Available for most items ordered before 12:00 PM Pacific Time on business days. Exclusions apply — see below.

Same-Day Shipping Exclusions

The following items require additional preparation and are excluded from same-day shipping:

  Accordions and reed system instruments — tuning and quality control required.

  Concert string instruments such as cellos, violins, and violas — setup and quality control required.

  Brass and wind instruments — quality control required.

  Heavy or oversize items — freight scheduling required.

  Any instrument requiring full inspection to comply with warranty requirements.

Shipping Charges & Carriers

Free Standard Shipping applies to the contiguous 48 U.S. states only. Standard charges apply to Alaska, Hawaii, Puerto Rico, APO and FPO addresses, PO Boxes, and U.S. Territories. Oversize or freight items may require additional shipping charges shown on the product page. Some orders may ship in multiple packages.

PlayMusic123.com selects the carrier at its sole discretion and reserves the right to change carriers at any time. Carriers used include UPS, FedEx, USPS, and freight carriers such as FedEx Freight, Watkins, and Saia.

Title & Risk of Loss

All items purchased from PlayMusic123.com are made pursuant to a shipment contract. Risk of loss and title for purchased items passes to the buyer upon delivery to the carrier. PlayMusic123.com is not responsible for items lost or damaged after delivery to the carrier, except as covered under the damaged shipments procedure below.

Estimated Delivery Times

All delivery times are estimates in business days after shipment and do not include processing time:

  Contiguous 48 states: 5 to 10 business days.

  Alaska and Puerto Rico: 10 to 20 business days.

  Hawaii: Ships via USPS air. Delivery times vary.

  APO and FPO addresses: 10 to 14 business days via USPS. Boxes over 70 lbs cannot ship to these locations.

  U.S. Territories such as Guam and USVI: 10 to 14 business days via USPS.

  International: 10 to 30 business days depending on customs.

  Canada Ground: Delivery times vary. Brokerage fees are not included.

 

Delivery times are estimates only and are not guaranteed. Carrier delays, weather, and customs processing can affect delivery.

Shipping Errors

PlayMusic123.com will charge the customer for shipping costs resulting from errors caused by the customer. Such errors include shipment refusal by the customer, incorrect address provided at checkout, address change requests after shipment, and failed delivery attempts. Shipping error charges include return shipping costs, address correction charges, and reshipment costs. PlayMusic123.com is not responsible for errors caused by the customer relating to instrument setup, assembly, or adjustment that are unrelated to product quality.

International Shipping

PlayMusic123.com ships worldwide. International customers are responsible for all customs duties, taxes, brokerage fees, and import charges. These are not included in the product price or shipping cost. PlayMusic123.com cannot mark packages as gifts or undervalue shipments on customs forms as doing so is illegal.

Some items may be subject to manufacturer restrictions for certain international destinations. APO and FPO orders ship via USPS only. Oversize items cannot be shipped to APO and FPO addresses.

 

6. Returns, Exchanges & Refunds

Please see our Returns & Exchange Policy page for the complete returns procedure. A summary is provided below.

45-Day Return Window

PlayMusic123.com accepts returns within 45 days from the date of purchase. Items must be unused and in the same original condition and packaging in which they were received. All returns require a Return Authorization Number (RAN) obtained in advance from support@playmusic123.com or by texting (888) 285-5308. Returns sent without a RAN will not be accepted.

Refunds

Once a returned item is received and inspected, the refund is issued to the original payment method. Please allow 10 to 15 business days for the refund to appear in the account. PlayMusic123.com does not issue refunds for shipping charges.

  IMPORTANT: PlayMusic123.com does not accept returned merchandise that arrives damaged in shipment, without original packaging, or without the original receipt or RAN. PlayMusic123.com will not issue return shipping labels (call tags) for returns.

Non-Returnable Items

The following items cannot be returned or exchanged under any circumstances due to legal, health, and manufacturing restrictions:

  Health and hygiene items: mouthpieces, reeds, harmonicas, internal earphones, earplugs, microphones.

  Instrument categories: accordions, brass instruments, woodwind instruments, band instruments, and any item affected by heat, cold, dryness, or moisture.

  Consumables: drumheads, drumsticks, opened strings, DJ cartridges and styli, cleaning products, rosin, tubes, fog fluid.

  Media and software: opened software, books, videos, CDs.

  Specialty items: vintage items, demo gear, custom or special order items.

14-Day Return Window

The following items have a shorter 14-day return window instead of the standard 45 days: recording devices including multitrack and mixdown recorders, DJ mixers, turntables and CD players, studio monitors, professional workstation keyboards, rackmount signal processors, fog machines, and lighting effects.

Damaged Shipments

Please see our Returns & Exchange Policy and Shipping & Delivery Policy pages for the complete damaged shipment procedures. For standard carrier shipments (FedEx, UPS, DHL), the customer must contact the carrier within 5 business days of delivery. For freight shipments, the customer must refuse the shipment at the time of delivery. Failure to follow proper procedures voids the damage claim.

 

7. Instrument Condition & Setup

All instruments sold at PlayMusic123.com are brand new unless explicitly stated otherwise in the product listing. Each instrument is inspected by skilled technicians at our distribution center prior to shipment.

Because musical instruments are inherently sensitive, they can go out of adjustment during the shipping process. If this occurs, minor adjustments such as tuning may be necessary upon receipt. Some items require assembly or initial setup. It is the customer's responsibility to perform these steps including tuning, adjustments, and the removal of packaging and protective supports.

Natural products such as wood cannot be guaranteed against cracking, seam separation, warping of the fingerboard, or chipping due to their organic nature and sensitivity to environmental conditions.

8. Special Orders

A special order is any product that is not regularly stocked and must be custom-manufactured, customized, or specifically sourced from the manufacturer at the customer's request. Special orders are final sale once placed and cannot be canceled, modified, or returned for any reason. Special order items may require up to 120 days for production and delivery depending on manufacturer availability.

By placing a special order, the customer acknowledges and agrees to these terms.

 

9. Inventory & Product Availability

PlayMusic123.com inventory availability is not guaranteed in terms of in-stock status or restock dates. Inventory information is estimated and may change without notice. Product prices, descriptions, and designs may also change without notice. PlayMusic123.com reserves the right to cancel any order if an item becomes unavailable after the order is placed and to issue a full refund.

 

10. Limited Warranty

Most new instruments sold by PlayMusic123.com include the manufacturer's warranty. Warranty terms vary by brand and product and are set by the manufacturer, not by PlayMusic123.com. Warranty coverage typically includes manufacturing defects in materials and workmanship. Warranty does not cover damage resulting from misuse, accidents, normal wear and tear, modifications, or improper setup.

Proof of purchase is required for all warranty claims. Some D'Luca brand instruments may require full inspection and quality control before shipment to comply with warranty requirements.

 

DISCLAIMER OF WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAYMUSIC123.COM EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING ANY PRODUCTS SOLD, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

 

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAYMUSIC123.COM SHALL NOT BE LIABLE FOR: LOST PROFITS, LOSS OF BUSINESS, LOSS OF DATA OR SOFTWARE, OR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, PUNITIVE, OR STATUTORY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

FOR ANY LIABILITY ARISING OUT OF THE PURCHASE OF PRODUCTS OR SERVICES FROM PLAYMUSIC123.COM, WHETHER FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, PLAYMUSIC123.COM'S MAXIMUM LIABILITY SHALL NOT EXCEED THE TOTAL DOLLAR AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC PURCHASE GIVING RISE TO SUCH CLAIM.

 

Some states do not allow the exclusion or limitation of incidental or consequential damages. The above limitation may not apply to you depending on the laws of your state.

 

12. Customer Notification Responsibility

It is the customer's responsibility to ensure that emails from PlayMusic123.com are not blocked by spam filters. Please add support@playmusic123.com to your email Allow List or Address Book. PlayMusic123.com is not responsible for notifications that are not delivered due to spam filtering, incorrect email addresses, or full inboxes.

PlayMusic123.com confirms all requests by providing a confirmation email with a reference number. Please request confirmation for any request submitted by email.

 

13. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of California, as those laws are applied to contracts entered into and performed entirely within California, without regard to conflict of law provisions.

Any dispute, claim, or legal action arising out of or relating to this Agreement, or the purchase of any products or services from PlayMusic123.com, shall be commenced and maintained exclusively in the state or federal courts located in Riverside County, California. By purchasing from PlayMusic123.com, you irrevocably submit to the exclusive personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue.

  IMPORTANT: Any legal action brought by or against PlayMusic123.com must be filed in Riverside County, California. This applies to all customers regardless of where they are located.

 

14. Changes to These Terms

PlayMusic123.com reserves the right to update or modify these Terms of Service at any time without prior notice. Changes are effective immediately upon posting to the website. It is the customer's responsibility to review these terms periodically. Continued use of the website or placement of orders following any changes constitutes acceptance of the revised terms.

Placing an order indicates your acceptance of all terms and policies stated on this page and throughout the PlayMusic123.com website at the time of your purchase.
